II. Conditions of access to and use of the Site www.zoli99.com

Access to the Site as well as the use of its content, including photographs, are subject to the conditions of use described below.

The fact of accessing and browsing the Site constitutes, on the part of the visitor, an unreserved acceptance of the following stipulations.

The name ZOLI99 and the logo have been registered by the Company P.I Distribution as Belgian, Community trademarks under the number 1319132.

The Belgian brands ZONS and its logo, their international extensions and the domain name www.zonshome.com are and will remain the exclusive property of the Company P.I Distribution .

Any use of the term "ZONS" or the logo to designate products identical or similar to those of the Company P.I Distribution on any medium whatsoever is strictly prohibited and would constitute an infringement of the trademarks of the Company P.I Distribution as provided for and sanctioned by articles L.713-2 et seq., L.716-1 et seq. and L.717-1 et seq. of the Intellectual Property Code. 1) Intellectual property ZOLI99

a. Brand ZOLI99 and its logo

Article L.716-9 of the French Intellectual Property Code provides in particular that :

"Is punishable by four years imprisonment and a fine of 400,000 euros for any person who sells, supplies, offers for sale or rents goods presented under a counterfeit trademark:

(a) To import, export, re-export or trans-ship goods presented under an infringing trademark;

b) To industrially produce goods presented under an infringing trademark (...); "Article L.716-10 of the same Code provides in particular that :

"Is punishable by three years' imprisonment and a fine of 300,000 euros for any person:

a) To hold, without legitimate reason, to import or export goods presented under a counterfeiting trademark ;

b) Offering for sale or selling goods presented under an infringing trademark; (...)".

The Site, its presentation and its content, both the texts and all the photographs are protected by the provisions of the Intellectual Property Code, and in particular under copyright by articles L.122-1 and following of the Intellectual Property Code.

The Site, its presentation, its contents and the integrality of its photographs and images are and will remain the exclusive property of the Company P.I Distribution which is the only one entitled to use and exploit the intellectual property rights and personality rights attached to the Site, in particular the drawings and models, the copyrights and the right to the image, as an original title or by the effect of an assignment or a license of exploitation.

Pursuant to the Intellectual Property Code and, more generally, international treaties and agreements containing provisions relating to the protection of copyright, the visitor is prohibited, in whole or in part, from reproducing, downloading, selling, distributing, issuing, broadcasting, adapting, modifying, publishing, communicating, in any form whatsoever and on any medium whatsoever the presentation, organization or content of the Site, including all photographs.

Any violation of the rights and obligations listed above would constitute an infringement of the intellectual property rights of the Company P.I Distribution as provided for and sanctioned by articles L.331-1 et seq. and articles L.335-1 et seq. of the Intellectual Property Code.

Article L.335-2 of the Intellectual Property Code provides in particular that :

" Any edition of writings, musical composition, drawing, painting or any other production, printed or engraved in whole or in part, in defiance of the laws and regulations relating to the property of authors, is a counterfeit and any counterfeit is an offence.

The counterfeiting in Belgium of works published in Belgium or abroad is punishable by three years' imprisonment and a fine of 300,000 euros. (...) "Article L.335-3 of the Intellectual Property Code provides in particular that :

"(...) Any reproduction, representation or distribution, by any means whatsoever, of a work of the mind in violation of the rights of the author, as defined and regulated by law, is also an offence of counterfeiting. (...)".

The creation of hypertext links towards the Site can be made only with the written and preliminary authorization of the Company P.I Distribution. This authorization may be revoked at any time. However, the Company P.I Distribution declines any responsibility concerning the contents of the sites linked to the Site.

Within the framework of the consultation and use of the Site, P.I Distribution may collect and record information relating to visitors, natural persons, constituting personal data.

In accordance with the provisions of the law "Informatique et Libertés" n°78-17 of January 6, 1978, the authorized treatment of the personal data thus collected was the subject of a declaration with the National Commission of Data processing and Freedoms (CNIL) under the registration number: 1617921.

Any person has, on a permanent basis, a right of access, modification, rectification and deletion of personal data concerning him/her pursuant to articles 39 and 40 of the French law "Informatique et Libertés" n°78-17 of January 6, 1978. 4) Access to the Site

Access to all or part of the Site may be suspended or deleted by simple decision of the Company P.I Distribution in case of force majeure, computer or technical difficulties, difficulties related to the structure of the telecommunications networks, blocking of the telecommunications networks, strike, national or local state of emergency, bad weather without this list being exhaustive.

Likewise, access to the Site may be interrupted at any time and without notice for maintenance reasons.

The Site is subject to modifications and developments, including in terms of functionalities, at any time and without prior notice of any kind and without the visitor being able to invoke any prejudice whatsoever.

The present conditions are governed by Belgian law. The Belgian courts have exclusive jurisdiction for any dispute relating directly or indirectly to access to this Site or its use.
